Can Delta-8 Gummies Cause Me Legal Trouble?

When we talk about Delta-8 THC, we are talking about one of the lesser-known constituents of the Hemp plant. A lot of people are surprised to learn that Delta-8 THC is legal because of the fact that it’s a close relative of Delta-9 THC. Delta-9 THC is found in Marijuana and is the source of its inebriating effects. Delta-8 is very similar, and it even gives you a little bit of a buzz. As such, we can tell that this substance remained illegal only because the authorities did not see it coming. 

This puts Delta-8 THC into a legal grey area, which can be problematic. It is technically legal in all 50 states, which means that you will not get arrested for illegal drug possession, but that doesn’t mean it can’t be mistaken for Marijuana. If you tell them you have been eating gummies that contain a legal form of THC, it isn’t likely to improve your situation. Some people will automatically judge you as a user of illegal drugs. The best way to avoid all of this is to document your use of Delta-9 gummies so that you have plenty of evidence. For instance, if a police officer stops you and asks if you have been smoking Marijuana, show him the gummy package as evidence that you are telling the truth. If you are about to take a drug test, let them know in advance that you have taken Delta-8 THC. Otherwise, they are not likely to test for that specific cannabinoid, and your test will simply show a positive for THC. 

Delta-8 Gummies Can Be Mistaken For THC Gummies

Let’s not forget about the fact that some states have made Cannabis completely legal. In such states, you can normally go into a dispensary and buy all kinds of edibles, including gummies. In most cases, you don’t even have to have a prescription. Of course, those gummies are made with Delta-9 THC and are intended for recreational rather than medicinal use. But you tell us: How is the average cop or security guard supposed to know the difference?

Until those gummies go to a laboratory and get tested, there will be no way to know. Thus, they will probably just go ahead and lock you up until the test results come back. That could take days or even weeks, depending on the efficiency of that particular lab. The best way to deal with this problem is to simply avoid carrying your gummies with you in public. If you really want to get covert, you can put your Delta-9 gummies in a bag that is intended for regular gummies. 

Delta-8 Gummies Are Not Always On The Level

If you don’t buy your Delta-8 disposables or gummies from a reputable source, there is always the chance that they could be contaminated with Delta-9 THC. Of course, this probably won’t bother you very much, but it can get you into trouble. This is another reason that you shouldn’t keep Delta-8 gummies on your person when in public. Just buy them and take them home. It isn’t advisable to drive a car after eating these things, anyway.

Contamination can easily occur because all of these compounds come from the same plant. The law specifies that a Hemp plant must have no more than 0.3% Delta-9 THC, but nature doesn’t always conform to those rules. If the grower is not regularly testing their products, some technically illegal plants can definitely slip through. That will result in gummies that have more than the legal limit of Delta-9. If you are caught with these, you could be charged with a felony.


We should mention that most users of Delta-8 gummies will never have the problems listed above. If you take care to avoid drawing attention to yourself while under the influence of Delta-8, then you should have no problems.
